Variant of NAPCS Canada 2017 Version 2.0 - Manufacturing and Logging Rev.1 - Updated December 11, 2020

213 - Cannabis products

This group comprises cannabis viable seeds and vegetative plants; fresh and dried cannabis (buds and leaves); cannabis oil; other cannabis extracts and concentrates; cannabis-infused edible products; and other cannabis products n.e.c., for non-medical (recreational, wellness, lifestyle, spiritual, etc.) and medical uses. A plant of the genus Cannabis refers generally to three varieties which are cannabis Sativa, cannabis Indica and cannabis Ruderalis. Sativas and Indicas are the most commonly used cannabis strains for cultivation and propagation. The genetics of the different cannabis strains are widely mixed or cloned to create cannabis hybrids. Cannabis contains a number of active elements, including cannabinoids such as tetrahydrocannabinol (THC) or dronabinol, cannabidiol (CBD) and terpenes (aromatic compounds or chemical markers). Cannabis plants containing 0.3% w/w (weight for weight) of THC or less in the flowering tops and leaves - industrial hemp - and their derivatives with the THC concentration of 10 µg/g or less, as well as prescription drugs or pharmaceuticals containing cannabis, are excluded from this group.

  • Exclusion(s)

    • medicinal chemicals and pharmaceutical preparations containing THC and/or CBD as ingredients (See 273 Pharmaceutical and medicinal products)
    • true hemp seeds and vegetable materials not aimed at producing intoxicating and hallucinogenic cannabis (0.3% w/w or less of THC) (See 115 Other crop products)

21313 - Cannabis products (except seeds, plants, and plant parts)

This class comprises cannabis oil and other solid and non-solid cannabis extracts and concentrates; cannabis-infused edibles; and other cannabis products n.e.c., made of cannabis bred to contain cannabinoids, in particular THC (more than 0.3% w/w) and cannabidiol (CBD), for non-medical (recreational, wellness, lifestyle, spiritual, etc.) and medical uses.

213131 - Cannabis oil

This subclass comprises cannabis oil, in bulk or prepared for retail sale, for non-medical and medical uses. Cannabis oil refers to an oil-based solution containing cannabinoids in their natural form, such as delta-9-tetrahydrocannabinol (THC) and cannabidiol (CBD), as well as other cannabinoids (CBC, CBG and CBN), and aromatic compounds (terpenes), which are mainly extracted from fresh or dried cannabis (buds and leaves), and dissolved in a carrier oil. Cannabis oil must be liquid at room temperature of 22 +/-2 degrees Celsius, contain no more than 30 milligrams of THC per millilitre of oil, when sold in bulk form, and 10 milligrams of total THC in capsule form or per dose of a metered product, and have a maximum yield percentage of 3% w/w or less of THC, taking into account the potential to convert the delta-9-tetrahydrocannabinol acid (THCA) to neutral forms of THC. Cannabis oil does not contain any added flavour, scent or non-cannabis related substance other than carrier oil.

  • Exclusion(s)

    • cannabis-infused cooking oils (See 2131332 Cannabis-infused edible products (except beverages))
    • hempseed oil (except when extracted for its CBD content) (See 1821341 Other vegetable oils (crude, once-refined, fuel-grade or industrial))
    • pharmaceutical preparations containing THC and/or CBD as ingredients (See 27311 Pharmaceutical and medicinal products)

213132 - Cannabis extracts and concentrates (except oil)

This subclass comprises cannabis extracts and concentrates, except cannabis oil. Cannabis concentrates refer to derived extracts (solid and non-solid) containing concentrated amounts of the psychoactive compound tetrahydrocannabinol (THC), cannabidiol (CBD), and a multiplicity of other cannabinoids and terpenes. Cannabis solid and non-solid concentrates refer to substances that are in solid and non-solid forms at a room temperature of 22 +/- 2 degrees Celsius and that have a maximum yield percentage of greater than 3% w/w of THC, taking into account the potential to convert the delta-9-tetrahydrocannabinolic acid (THCA) into THC. Their use can be non-medical or medical. Generally, there is a limit on the level of THC a product available for sale could contain.

  • Exclusion(s)

    • cannabis oil (maximum yield percentage of 3% w/w or less of THC) (See 213131 Cannabis oil)

213133 - Cannabis-infused edible products

This subclass comprises cannabis-infused edible products (beverages, food, etc.) containing more than 0.3% w/w of the psychoactive compound tetrahydrocannabinol (THC), cannabidiol (CBD), and other cannabinoids and terpenes. Their use can be non-medical or medical. Generally, there is a limit on the level of THC a product available for sale could contain.

  • Exclusion(s)

    • cannabis extracts and concentrates (See 213132 Cannabis extracts and concentrates (except oil))
    • cannabis-infused animal feeds (See 2131341 Other cannabis products, n.e.c.)
    • carrier oils containing cannabinoids such as THC and CBD (See 213131 Cannabis oil)

213134 - Other cannabis products, n.e.c.

This subclass comprises other cannabis products n.e.c., including processed cannabis products n.e.c., containing more than 0.3% w/w of the psychoactive compound tetrahydrocannabinol (THC), cannabidiol (CBD) and other cannabinoids, for non-medical and medical uses.
